EKR declaration form changes on 31 March 2020

From 31 March 2020, changes take effect in the set of electronic declaration forms defined by Section 11(7) of Government Decree 424/2017. (XII. 19.).

Under Section 11(7) of Government Decree 424/2017. (XII. 19.) on the detailed rules of electronic public procurement, changes take effect from 31 March 2020 in the set of electronic declaration forms.

New forms in newly created procedures

In the Electronic Public Procurement System (EKR), procedures (procedure transactions) created by the contracting authority after 31 March 2020 for the purpose of preparing a public procurement procedure will be generated with the updated declaration forms and will no longer include the forms that have been withdrawn.

Previously created procedures: no automatic switch

For procedures (procedure transactions) created in the EKR by the contracting authority before 31 March 2020 for the purpose of preparing a public procurement procedure, the change is not applied. Those procedures may therefore be launched and conducted using the forms available at the time they were created.

Technical change: option to keep using earlier forms

Because the modification and withdrawal of the forms stems from a technical rather than a statutory change, contracting authorities are entitled, when launching and conducting the procedure, to use the electronic forms that were available at the time the procedure transaction was created and prepared. This is in line with Section 11(8)(a) of Government Decree 424/2017. (XII. 19.).
