Exclusion Grounds in Public Procurement Procedures

An exclusion ground is a legal violation or deficiency that prevents an economic operator (company or business) from participating in a public procurement procedure and whose absence must be demonstrated through the prescribed documents. Examples include tax debts, criminal records, formal errors, false declarations, or competition law violations. Required supporting documents may include, for example, a tax clearance certificate issued by the National Tax and Customs Administration, a certificate of clean criminal record, or certain financial suitability documents.

In practice, the most common reasons for exclusion are failure to comply with formal requirements, submission of incomplete documentation, or missing the tender submission deadline. However, a successful bid requires not only the avoidance of exclusion grounds but also meeting the suitability criteria appropriate to the nature of the procurement, such as demonstrating the required references or revenue requirements.
